Booking terms
Payment, cancellations and what we need from you for on-site training. Please read these before you book.
01About these terms
These terms apply to all training courses and services booked with OccuSafe Ltd (“OccuSafe”, “we”, “us”). “You” means the company or person making the booking. By confirming a booking, you agree to these terms.
OccuSafe Ltd is a private limited company registered in England and Wales, company number 17532533. Registered office: Office 1, Izabella House, 24-26 Regent Place, Birmingham B1 3NJ.
If you are booking as an individual rather than as a business, nothing in these terms affects your legal rights as a consumer.
02Quotes and bookings
- Our quotes are based on the course, number of delegates and location you give us.
- A booking is confirmed when we confirm it to you in writing (email is fine).
- Please check your booking confirmation and tell us straight away if anything is wrong.
03Prices and VAT
Prices are as shown on your quote or booking confirmation. OccuSafe Ltd is not VAT registered, so no VAT is added to our prices.
04Payment
- Full payment is due before the course date. We will send you an invoice when you book.
- If payment has not reached us by the course date, we may postpone the course until it has.
- If we agree in writing to invoice you after a course, payment is due by the date shown on the invoice.
05Late payment
If a business customer pays late, we may charge statutory interest and fixed compensation under the Late Payment of Commercial Debts (Interest) Act 1998:
- Interest at 8% a year above the Bank of England base rate, from the date payment was due until it is paid.
- Fixed compensation of £40 for debts up to £999.99, £70 for £1,000 to £9,999.99, and £100 for £10,000 or more.
- Reasonable extra costs of recovering the debt, where these are more than the fixed compensation.
06Cancelling or moving a booking
If you need to cancel or move a booking, tell us by email at Bookings@occusafe.co.uk. The notice period is counted in working days (Monday to Friday, not including bank holidays) before the course date.
Moving a course to a new date is treated in the same way as a cancellation. If you have already paid, we will refund anything owed to you under this scale.
07Changing delegates and no-shows
- Swapping delegates is free. Just send us the new name before the course starts.
- No-shows are charged in full. This includes delegates who arrive too late to take part safely.
- A trainer may remove a delegate who behaves unsafely, is unfit to take part (for example under the influence of alcohol or drugs), or disrupts the course. The full fee still applies.
08If we have to cancel
Occasionally we may need to cancel or move a course, for example because of trainer illness, severe weather, or because the site is not safe to train on. If this happens for a reason that is not your responsibility, we will offer you a new date at no extra cost or a full refund of what you have paid for that course. We are not responsible for any other costs or losses caused by the change.
09Training on your site
For on-site courses, you must provide the following at no cost to us:
- A training or meeting room with enough seating, tables and power for the group.
- Welfare facilities: toilets, hand washing, drinking water and somewhere to take breaks.
- Plant needed for the course (for example an excavator or crane for slinger signaller training, or vehicles for vehicle marshal training), with competent, authorised operators and in-date inspections.
- Lifting accessories such as chains, slings and shackles for lifting courses. These must be in date, marked, and thoroughly examined under LOLER, with records available.
- A safe, segregated area for practical work, including lifting and cutting (for example on cut-off saw and abrasive wheels courses).
- A site induction for our trainer, and details of any site rules or hazards we need to know about.
We will normally bring all other training equipment. If, when we arrive, the site, plant or equipment is not ready or not safe, our trainer may delay or stop the practical part of the course. If the course cannot go ahead for this reason, it will be charged as a cancellation with less than 5 working days’ notice.
10What delegates need
- Suitable PPE for the course. As a minimum this is usually a hard hat, hi-vis, safety boots and gloves, plus eye or hearing protection where needed. We will tell you what is needed when you book.
- To be fit to take part in practical activities.
- Photo ID, where an awarding body requires it. We will tell you if this applies.
- Please tell us before the course about any learning, language or access needs so we can support the delegate.
11Certificates and results
- Certificates are issued to delegates who successfully complete the course and any assessment.
- For accredited courses (for example NOCN SiteRight), certificates and cards are issued by the awarding body, on its own timescales.
- We cannot guarantee that every delegate will pass. If a delegate needs to be reassessed or attend again, we may charge for this.
12CITB grants
Some courses may be eligible for CITB grant funding. Claiming any grant is your responsibility, and payment of our fees does not depend on whether a grant is approved.
13Partner companies
Some courses and services may be delivered on our behalf by trusted partner training providers or specialists. OccuSafe stays responsible for your booking.
14Our liability
We deliver our training with reasonable care and skill. Training helps your team work safely, but it does not replace your own legal duties as an employer or principal contractor, including risk assessment, supervision and safe systems of work.
We are not liable for indirect losses, such as loss of profit or delays to your project. Our total liability for any booking is limited to the price paid for that booking. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
15Your personal information
We use delegates’ and customers’ information as explained in our privacy policy.
16Questions and complaints
If you have a question or are unhappy with any part of our service, please contact us at Bookings@occusafe.co.uk or on 0121 816 2044 and we will do our best to put it right.
17Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
